This Privacy Policy applies to the website on which it is posted, and all subdomains, other websites, applications, widgets, products, services, and other Services owned and operated by Owner (including its affiliates) that link to this Privacy Policy.


By using this Site, you signify your agreement to the terms of our Privacy Policy. If you do not agree with these terms, please do not disclose any personal information through our Services.

WHAT INFORMATION DO WE COLLECT?


When you visit the Site, you may provide us with two types of information: (1) personal information you knowingly choose to disclose that is collected on an individual basis, and (2) personal information that is automatically collected along with website use information collected on an aggregate basis as you and others browse the Site.


1. Personal Information You Choose to Provide


You do not need an account to post listings, browse listings, or respond to listings.


If you choose to create an account and/or use our Services, we may collect personally identifiable information that you submit such as your name, contact data (address, email address, phone number) and other information that you enter into the Services. Likewise, we may also collect additional personally identifiable information that you voluntarily include in your listings or transmit with your communications to us.


The information that you provide when you post a listing is displayed in public areas and available to all visitors. Any information that is disclosed in these areas becomes public information, so please exercise caution. We also provide you with the option to submit pictures and/or a description of your item or service. When you post your listing on the Site, the description and pictures are displayed on the Site and accessible to visitors on the Site.


If you provide personal information to a buyer or seller (either directly or by circumventing our messaging system), we have no control over how that information might be used by the recipient.


2. Web Site Use Information


Similar to other commercial websites, the Site utilizes a standard technology called "cookies" (see explanation below, "What Are Cookies?"), web server logs, along with web beacons, tracking pixels, and similar tracking technologies, to collect information about how the Site is used. Information gathered through cookies, web server logs, and associated technologies may include the date and time of visits, the pages viewed, time spent at the Site, and the websites visited just before and just after the Site. We, our advertisers and ad serving companies providing services to us, may also use small technology or pieces of code to determine which advertisements and promotions users have seen and how users responded to them.

We may also share personal information with service providers who help with our business operations, and third-party websites and publishers so the listings (or the content of the listings) published on the Site can also be published on a broader array of websites.


What are Cookies?


A cookie is a very small text document, which often includes an anonymous unique identifier. When you visit a website, that site's computer asks your computer for permission to store this file in a part of your hard drive specifically designated for cookies. Each website can send its own cookie to your browser if your browser's preferences allow it, but (to protect your privacy) your browser only permits a website to access the cookies it has already sent to you, not the cookies sent to you by other sites. As we develop our business, we may buy or sell assets or business offerings. Customer, email, and visitor information is generally one of the transferred business assets in these types of transactions. We may also transfer such information in the course of corporate divestitures, mergers, or any dissolution.

Occasionally, we may also use the information we collect to notify you about important changes to the Site, new services and special offers we think you will find valuable. As our customer, you will be given the opportunity to notify us of your desire not to receive these offers.


HOW DO WE PROTECT YOUR INFORMATION?


How Do We Secure Information Transmissions?


We may employ procedural and technological security measures that are reasonably designed to help protect your personally identifiable information from loss, unauthorized access, disclosure, alteration or destruction. We may use secure socket layer and other security measures to help prevent unauthorized access to your personally identifiable information.


Certain Disclosures


We may disclose your personal information if required to do so by law or subpoena or if such action is necessary to (a) conform to the law or comply with legal process served on us or affiliated parties; (b) protect and defend our rights and property, our Site, the users of our Site, and/or our affiliated parties; (c) act under circumstances to protect the safety of users of our Site, us, or third parties.


Delete Your Information


If you have an account for our Services, you may update, correct or delete information about you at any time by logging into your online account and modifying the settings/information in your profile. If you wish to delete your information, you can do so in two ways:


  • The first is to delete your account. To delete your account, log in and go to the Your Stuff page. From there, click the orange "Edit settings" button towards the bottom of the page. Next click the red "Delete all" button. You will be required to enter your password one more time. This will permanently delete your account and all of your information from our system; this action cannot be undone.
  • Please let us know through this web form that you wish to delete your information. You will need to provide identifying information such as your email, account ID, or ad ID.

Note that we may retain certain information as required by law or for legitimate business purposes. We may also retain cached or archived copies of information about you for a certain period to the extent required by law.


WHAT RIGHTS DO YOU HAVE UNDER STATE PRIVACY LAWS?


In addition to the rights described in this Privacy Policy, the California Consumer Privacy Act of 2018 (“CCPA”), as well as privacy laws in Colorado, Connecticut, Montana, Oregon, Texas, Utah, and Virginia (collectively, “State Privacy Laws”), provide consumers residing in that state certain additional rights with respect to their personal information. If you are a resident of a state that has enacted State Privacy Laws, this section applies to you as indicated. This section also applies to residents of the above states who are interacting with the Owner in a business or commercial capacity.

Note that if you place an order for Services and/or pay a fee, we will collect additional payment and billing information from you, such as your credit/debit card information. We do not store or retain sensitive information such as full credit card or debit card numbers, bank account information, or other financial information that could be used directly to access a person's financial account; however, we do store the transaction tokens that can be used to retrieve, and in some cases submit, information associated with your transaction to our service providers (such as the last four digits of a payment card).


We retain personal information for as long as necessary to carry out the purposes for which we originally collected it and for other purposes described in this Privacy Policy.


Notice of Information Collected and/or Disclosed for “Sales” or “Sharing”


State Privacy Laws require that we notify you if we use your personal information to display advertisements to you based on personal information obtained from your activities over time and across nonaffiliated websites or online applications.


Specifically, the CCPA requires that we notify you about personal information that we “sell” or “share.” Under the CCPA, “sale” means the disclosure of personal information to third parties in exchange for valuable consideration, while “sharing” means the disclosure of personal information to a third party for cross-context behavioral advertising.


We use your personal information for cross-context behavioral advertising to allow our advertising partners to collect certain information to show you targeted advertisements, which may be considered both “sharing” and a “sale” under the CCPA, and may be deemed “targeted advertising” under other State Privacy Laws. For purposes of the CCPA, we do not knowingly sell or share personal information under the age of 16. To opt out of these activities, please see “Consumer Rights Under State Privacy Laws” below.

We do not sell Consumer Information, nor share Consumer Information with any third parties except to the extent necessary to provide the Services to you.


Consumer Rights Under State Privacy Laws

Subject to certain limitations, consumers granted rights under State Privacy Laws have the right to (1) request to know more about the categories and specific pieces of personal information we collect, use, and disclose, (2) request deletion of your personal information, and/or (3) request correction of your personal information. We will not discriminate against you if you exercise your rights under applicable State Privacy Laws.


Consumer Rights under the CCPA

Under the CCPA, consumers have the right to request that we disclose certain information to you about our collection and use of your personal information over the past twelve months. Once we receive and confirm your verifiable consumer request, we will disclose to you:


  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting that personal information.
  • The categories of third parties with whom we share that personal information.
  • The specific pieces of personal information we collected about you (data portability request).
  • If we sold or disclosed your personal information for a business purpose:
    • Sales: Identifying the categories of personal information that each category of recipient purchased.
    • Disclosures for a business purpose: Identifying the personal information categories that each category of recipient obtained.

If we deny your request, you may appeal our decision by contacting us using the contact methods provided in the preceding section. If you have concerns about the result of an appeal, you may contact the attorney general in the state where you reside.


You may only make a verifiable consumer request twice within a twelve-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify that you are the person about whom we collected personal information or an authorized representative of that person.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.


The rights above may be limited in some circumstances—for example, if fulfilling your request would reveal personal information about another person, where they would infringe the rights of a third party (including our rights) or if you ask us to delete information which we are required by law to keep or have compelling legitimate interests in maintaining.


Opt-Out Preference Signals

Some browsers allow you to enable privacy-controls in the browser’s settings to automatically signal your opt-out preference to the websites you visit (e.g., Global Privacy Control). As of the date on which this Privacy Policy was last updated, however, there is no standardized DNT signal, and so no uniform technological standards for recognizing and implementing such signals. As such, our Services do not currently respond to browser DNT signals or similar signals. If you do not wish to be tracked, you may also be able to opt out by selecting certain options in the settings browser or device that you use to access the Services, or by using certain third-party applications and programs.


Consumer Privacy Rights in the European Union, Switzerland, and the U.K.


If you use the Site, are located in Europe, and are subject to any one of (i) the General Data Protection Regulation, (ii) data protection laws implemented by member states of the EU in harmony with the General Data Protection Regulation, or (iii) the U.K. Data Protection Act of 2018, as amended and incorporated into U.K. law (collectively, the “GDPR”), the following applies with respect to your rights to exercise control over your personal information. Under the GDPR, you are a “Data Subject” and we are a “Data Controller” for any information that constitutes “personal information” under the GDPR that is processed under this Privacy Policy.

If you are not a Data Subject, the provisions in this section do not apply to you.


Lawful Grounds for Processing Personal Data of Data Subjects


We rely upon the following legal grounds to process personal information under the GDPR:

  • If you have consented to the processing of personal information for one or more specific purposes.
  • If the processing is necessary for the performance of an agreement with you (including for any pre-contractual obligations thereof), for our compliance with a legal obligation to which we are subject, to protect your vital interests or of another natural person, or otherwise for our legitimate interests.
  • If the processing relates to a task that is carried out in the public interest or in the exercise of official authority, as permitted by law.

Data Transfer Notice


We use servers located in the United States to process your personal information. By using our services, you acknowledge and agree that we are authorized to transfer your personal information for processing in the United States. Under the GDPR, the transfer of personal information to a country outside the EU may take place where the European Commission has determined that the country ensures an adequate level of protection. The transfer of your personal information to the United States in the absence of an adequacy decision by the European Commission is made because it is necessary for the performance of a contract with you, or with your explicit consent.


Retention of Personal Data


Pursuant to the GDPR, we will permanently erase your personal information at such time there is no lawful basis or legal obligation for us to store or process the personal information.

We will endeavor to respond to any requests within the period required by law, but in some instances it may take longer.   • You may obtain access to your personal information: You may obtain access to your personal information that we process.
  • You may request rectification: If you believe any personal information that we process is incorrect or incomplete, you may request that we correct it.
  • You may request deletion of your personal information: Under certain conditions, you may request that we remove or delete your personal information. For example, if there is no legitimate reason for us to continue processing it.
